I gave him my PIN also. After withdrawing the amount he didnot gave me card back and the very next day he withdrew 27,000 from my account and now he is not coming to office. How can I recover my money from him. I can spend Rs. 5,000 in this case. Please help me out.

Advocate Akshay Saxena answered
HI,First of all you need to file FIR against the man who took the atm card and next kindly contact your bank to get your atm card blocked so that he cannot use the card any longer. After the FIR has been registered it will be the job of the Police to nab him and after that we can file the case of theft against him to recover your money.Regards,

Q: Procedure for divorce if marriage is not registered.

Friend of mine want to get divorce but her marriage never get legally documented. In that case does she require to apply for divorce. If yes please let me know if there is any procedure to get help from government for females in case of divorce

Advocate Akshay Saxena answered
It is necessary to check whether the husband has mentioned the name of the lady as his wife. I would suggest to take a divorce first even if its not registered as Non-registration of marriage alone does not nullify married state.

Q: Negligence by airline served harmful substance in food what action

I Have traveled on 26th Feb. from delhi to Visakhapatnam by Air Asia airlines I pre booked the meal through that airlines online. I got the food from them during travel and when I started to eat the food I found very small plastic particles in my mouth so i took out from my mouth and I complaint to crew members they told me --MAY BE THE PLASTIC FORK BROKEN AND MIX IN THE FOOD". I saw the plastic fork that was broken on front side. But I surprised how that airlines can provide the poorest quality of fork and if that plastic went into the stomach it could be harmful to me. please advise me

Advocate Akshay Saxena answered
In such cases you can file a consumer complaint under section 12 of the consumer protection act against the airlines for deficiency in services and can get compensation from the airlines. If you want any other help I would be happy to give it to you.

Q: Purchased a phone but after 2 months not working property

I purchased a phone moto xplay of cost 18500 rs. for two months it worked fine but later stopped working i gave it in service centre still they didnt repair it its been two months they give a dead line and they skip on that date what to do am really worried about my phone

You can file a consumer case against the manufacturer and their authorised seller who sold you the phone. Since its Moto X play I guess Flipkart will be the authorised agent. So you can file a case against both of them for manufacturing defect and lack of service

Q: Company having contract with other company are we employees in that

There is a company who has employees an the employees have a contract with that company only but the company provides manpower to another company. Can the employees claim that they are employees of the other company as well? Any case that talks about such matter

Advocate Akshay Saxena answered
Definition of employer under section 2(e) of the PF Act defines employer as a person having 'ultimate control over the affairs of the establishment'. To establish ultimate control few things have to considered like: who is issuing employment contracts; pays wages and other allowances to the employee etc..If you wish to know further feel free to contact.
