Hi,Share of Mother is fixed i.e., 1/8 value of your father's property.The remaining brother and three sisters' total share would be 7/8. AND brother will get double of sister' share.Now if we go by percent, share of mother will be 12.5%. and the remaining 87.5% will be distributed amongst three sisters and one brother in such a way that brother will get double the share of sister. means if sister gets Rs. 100, then brother will get Rs. 200.
Q: How to add a person as a co-owner and avail tax benefits
I got a house on my name on 100% loan. I am claiming tax benefits on it. Now i want to add my wife as co-owner 50% plus co-borrower in loan 50% so that to extent of her share she can claim tax benefits. She and i will pay EMI to the extent of share..There is no consideration paid by me for property .Everything is on 100% loan. How wife can be added as co-owner and co-borrower? Whether she can claim tax benefits if make gift deed and add her as co-borrower with bank?

In my opinion what you can do is: ask your personal banker whether name of your wife can be incorporated as co obligant in the loan already sanctioned in your favor. If that is possible then the documents of loan shall have her name and subsequently on the basis of it you can get your wife's name registered in records of right of the house as well. And as then both of yours name will be in the loan agreements both would be able to avail benefits. Additionally you require to give instructions to your bank regarding drawing of proportionate EMI from each of yours account, post incorporation of name of your wife. Yes it can be a ground for divorce. However , you should take this practically. Think about the future of your daughter and then move ahead with divorce on such ground. You may be asked to pay one third of your salary to wife and one fifth to your daughter for their maintenance. Also permanent alimony shall be quantified on basis of salary with perks plus the assets that you have less liability of dependent family members.

Hi,the following are documents required for the marriage under special marriage act.1. Birth certificate / School leaving certificate of both, boy & girl.2. I D proof of both3. Passport size four photos of both4. you have to submit an application before the registrar of marriage in person, the presence of both, girl and boy is necessary.5. After 30 days, you have to again visit the office of registrar with three witnesses and thereafter the certificate will be issued to you.The following documents are required for marriage under registration of marriage act i.e., for couple of same religion.1. Marriage certificate issued by pandit or moulavi.2. ID card of both3. Birth Certificate / LC of both4. Passport size four photos5. Marriage Invitation card6.
