Only photocopy of will available unregistered will and no witnesses.

15-Sep-2023 (In Wills / Trusts Law)

My son has produced a photocopy of my husband WILL who expired four years back. The WILL is on a plain paper and constitutes 10 pages and at the end of the 10th page it is signed by my husband. It is not signed on every paper and also not signed by Witnesses. Also the WILL is not registered. The original WILL is missing. I want to know is the photocopy WILL justified?

A photocopy of a Will can be used if it is shown that the original is either destroyed or missing. A photocopy of a Will can also be used in probate proceedings under such circumstances. A Will is not required to be registered. Your case would be much stronger if you could locate one of the attesting witnesses.
