Hi, My Mother would like to write a Will. She has 2.5 acres of agricultural land and owns passbook for land. Now, she wants to write a WILL that after she passes away, that land should belong to me as I am her daughter. So I would like to know the following things: 1. My mother has 2 sons and 1 daughter (me). When she writes a WILL, can her sons create a problem? 2. After my mother passes away, how should her daughter claim the property? 3. Can my mother write a WILL where her daughter can claim property before she passes away? Does my mother have an option like that? Please help.
Your mother can make the Will in your favour preferably she should have it registered . Will is effective only after demise of the executor so after her death, if your brothers claim their share and do not accept the Will then you will require to file case of probate. Once Will is probate you can approach the authority concerned for recording your name in property documents.

If your mother is the sole owner of the land, she may do with it as she pleases. This includes giving it to you in her will.
However, the proof of ownership should be under no doubt. Also the land should not belong to the grandparents or ancestors beyond them.
