Mother died intestate what can be done.

Our family is Hindu (Jain) Family .My father died in 2002 and mother in June 2013 .Both left one house ,bank balance and jewelry in locker. My youngest brother who is unmarried person was made responsible by mother as co account holder and nominated in bank account /FD account and locker to keep all wealth safe and sound in order.Our mother left no will .She was met an accident and died during prolonged illness after she met an accident during car driving by youngest brother who is central govt employee. Lot of amount was spent during the medical of mother. According to last wish some amount was distributed among-est brothers while rest kept by the Youngest brother who is not willing to clear the total account and balance if any to other brothers .

The answer to above query cannot be given in direct terms. The first question that needs to be answered if whether the property was purchased by the Husband or was an ancestral property that may have devolved upon the Mother from her father. As per the Sharia Law, your father will get 1/4th of the property.

Also important to know is whether the father of your mother is still alive. If not, then you will get 1/2 of the property and your sister will get 1/4th of the Property.
