Land gifted by will but not registered can loan be taken

13-Jan-2023 (In Wills / Trusts Law)
A piece of land has been gifted as will to my wife from her maternal grandfather. Now he has died, till now land has not been registered to my wife name. Can I apply for home loan on basis of will written on my wife name ? Or is it necessary to register the land for availing home loan .if yes then what is the process of registration. I am from a Hindu family from Bihar.

A photocopy of a Will can be used if it is shown that the original is either destroyed or missing. A photocopy of a Will can also be used in probate proceedings under such circumstances. A Will is not required to be registered. Your case would be much stronger if you could locate one of the attesting witnesses.
