Husband died without making will can husband's parents claim share

In case of flat held in joint names of husband and wife, if the husband dies without making a will, is mother or father of the deceased entitled to claim any right while deleting the name of husband on share certificate by the society on application from his spouse. If so, please advise of procedure to be followed in such cases as a matter of guidance to society.

Assuming you are Hindu, if the husband died without making a will then the wife will retain her share in the property as she is a joint holder of the property. Apart from that the deceased person's mother has a right to claim her share in the property.
