Claim of prperty which was given to my uncle by my grand father
18-May-2023 (In Wills / Trusts Law)
My grandfather was two sons & three daughters. Only the younger son was living with my grand father but the others were living separately with their own family members in other places. My grand father died in the year 1993 & my father(elder son) died in the year 2011. Few months back I came to know that my grand father had given his whole property to my uncle by a registered deed. The deed was executed when my grand father's age was eighty. My father was not at all aware of this deed. Now please let me know whether we can file a case in court against this deed mentioning the undue influence
If the property was a self acquired property of your grandfather then he has complete right over the property and your grandfather can dispose or transfer such property in a manner he wish to. You cannot challenge such transfer.
