Can we challenge Will prepared on 10 rupee stamp paper

15-Mar-2023 (In Wills / Trusts Law)

If father did some will on 10rupee stamp paper, it is only on Notary register. Is it valid to challenge the will if some property transaction is done based on the will terms. If mother is alive, how much property share she should get as will is jointly made by Mother and Father. Father expired but mother is alive.

A Will is a document where the owner of a property declares  the manner in which his property will be distributed after his death. A joint will is one that two people make together, each leaving all of their property and assets to the other. It also stipulates what will happen with the assets when the second person dies. This type of will is essentially a contract between the two makers and requires the consent of both for it to be revoked. Therefore your mother will have right over your father's property in case of a joint will.
