Refund of service tax for under construction property

I would like to know of any refund cases that you have handled successfully where service tax was refunded for an under construction property that was bought in a prelaunch in March 2013? What does the law says on this?
There is a Delhi High Court judgement which has ordered Refund of Service Tax collected by the builder on under-construction residential property. You may refer to and rely upon that and ask the builder for the refund.
