What are legalities for starting News aggregation app/website

Hi, I am thinking of building a website and an Android app which will display news aggregated from popular Indian News websites. I am planning to publish the news once in a day and the news items will be picked up manually and uploaded (It is not an automated news feed). Also I am planning to group the news items under different categories. I am planning to put the headline and a gist of the news, followed by mentioning the original source name, such as Times Of India, The Hindu etc. Is it legal to do this? If I generate revenue based on advertisements on the website and the app, will it create legal issues? Or is it mandated to provide the complete HTML link to the original news website for all the new items? Thanks, Ganesh.

The copyright related issues in news aggregation is a grey area in law. At the outset, the best approach would be to get some sort of a license or prior authorisation from the original content generators who hold the copyright to the content. Assuming that the same is not possible, follow an approach where: (i) the original content generator is acknowledged, and the link to the original content is provided; (ii) do not reproduce the content as is - reproduce only a summary that is generated in your own language; and (iii) make sure that there has been a value addition from your end - re-organise and analyse the data that is presented, so as to demonstrate that your skills and labour have been applied in compiling and presenting the data. It would be fine to use the revenue generated by advertisements. However, that would prevent you from using "fair use" as a defense later on given that the defense of fair use can be used only where the person using the defense has no commercial interest in the matter.
