Is promotion of a startup to same institution students illegal?

09-Sep-2023 (In Startup Law)
I am a du final year student and was promoting an ethical society cum organisation SARSO ( one of the founder member of FDSA ) in college which asks for 3000 rs for registration. The students had to do a normal shopping from the website of the society and then would get skill development trainings and would get registered with us as distributor of the direct selling organisation. My HOD and principal got to know about it and want to me to refund the money of students saying its illegal whereas I have in written by students saying they voluntarily have done it. The promotion was done for just 5 daus in a classroom of 30 students however money collection was done outside college and students were informed about everything. My hod and prinicpal have even denied to listen to my part and are forcing me to refund the money of students however students wish to be a part pf SARSO and are 18+. Teachers say I have done an offence and might be suspended for the same. Please help

Since activity was done in college, Principal & HOD are justified in taking action. On that front, I would hold them correct. Coming to your concern, it is advisable to refund money and prevent any damage to your final degree year. You can re-initiate this business outside college later. If you have students willing to be a part of your business, I see no concern as to why the business cannot be re-commenced later. Acted sensibly and do not make a hill out of a mole.

Doing any sort of business activities in among the students studying in the University at the time of their college session and in the campus premise itself without taking due permission from the administrative authority is not allowed and is subject to disciplinary action if the involved party is a student, staff, lecturer, professor etc.
You may be suspended or in worst case may be ousted from the college for the act done by you.
However the same rule allow you to explain your case to the authorities, to plead guilty or to plead mercy on the ground that you will not continue any such activities in the college campus and will obey the orders passed by the disciplinary committee in respect to same. In your case it is refunding the amount to those with whom you have taken the money.
But worry not, by all these steps taken your project will not get scrapped and it will remain in function provided you act legally and wisely under the aid and advice of a lawyer.
It would be better if you could come down to my office and explain the whole process of this project so that I may assist you on a better note.

What you have done is not illegal. As per Article 19 of the Indian Constitution, you have a right to freedom to trade and the students have a right to join an organisation on their own free will. However, it never pays to antagonise your college faculty. It is advisable you have a student body member/ a lawyer/ someone with experience talk on your behalf.

There is no law which bars you from promoting a startup to the same institution. However, what you do need to take a look at is the University/institution rules/bye-laws/code of behavior/ etc. If such activity is not permitted by the rules and bye laws, you might have trouble.
