Want to know about the rights of minority educational institutions

02-Jan-2023 (In R.T.I Law)

Can a minority educational institution enact laws against Fundamental Rights in the guise of exercising its right to administer the institution. In reference to the case of Farooq College, Kerala where boys and girls are not allowed to sit together on the same bench and a student was debarred for not following the said rule while the college claimed protection under Art. 30(1) of the Constitution

A minority educational institution has powers to administer its own affairs. It would come under the ambit of a "state" and therefore be amenable to writ jurisdiction if it is partly funded or administered by the government.
