Took home loan from bank but the plot was already allotted

we have borrowed a housing loan loan from a bank against the plot which was auctioned by the state development authority in 2007 paid all the EMI we came to know that the auctioned property was already allotted in 1992 to another person, development authority gave some plot which was not good and we asked refund with interest but thay gave only cost of the plot ,we have been badly affected from both the side for the loan of 48 lakhs we have already paid 60 lakhs and they still want us to pay 30lakhs,now being genral public i am suffering lot of mental agony. how can I take action against them

For that you have to give the paper because the Land was allotted to the person in 1992 and after that you have been taken Loan from that Property this is confusing if the Land do not your name so how would you take Loan on that from the Bank and more interesting the auctioned is also done it mean that you are not know when the Land is allotted to to you is already allotted to other person ad in the last i am in that position in that you get compensation from the state Development for Forgery and get Money from the bank which you have paid but for that the most important is paper in which we have to relaying

Suit for recovery along-with a writ petition against the government authority is the immediate and necessary step.

You can file a writ petition in the High Court and apply for proper reliefs saying that the state authority has played fraud on you by selling you property or by accepting money in relation to a property which already has been allotted to a third party. The facts show that the state authority has acted arbitrarily. In the same writ petition we can make the bank also a party and apply for stay on the payment of further 30 lacs as you say. I would like to see the papers involved in the matter so that I can guide you better.
