refund of fees as college has filed writ petition in high court

regarding refund of fees for my daughter in usha mittal eng college. after persuasion college appointed ombudsman to hear our case. after hearing both s he ordered college to pay Rs.77000 of the Rs.85000 fees. instead of paying up college has filed writ petition in mumbai high court asking decision of ombudsman to be squashed. what do we do. its 2 years now. with matter in high court can approach consumer court and any guidance for the same.
