Refund not given by real estate can I take legal action

A real estate company is not giving me refund of the advance paid even after I have cancelled my booking and have taken an official acknowledgement from them about the same. The stipulated time of 45 days is over. Can I proceed with a criminal case?
Dear Querist,
Make an application under Section 9 of the Insolvency and Bankruptcy Code, 2016 before the concerned NCLT having jurisdiction pursuant to serving a Demand Notice under Section 8 of the said Code.
Simultaneously, you may file a police complaint.
