Recovery of money from relative

Dear Sir, I paid some amount to one relative for purchase of land. I don't have any payment receipt or any evidence. For last one and half years, he is neither registering land nor returning my money back. He always says I will return your money and never denied for the money with him, but delaying for returning the same. Please guide

if you do not have any evidence then it is really hard to recover money from him but if you have any eye witness who has seen you giving money to him then it can be possible to file a recovery suit against him. but it will be better to consult a local lawyer because in your case detail fact is required for a proper advice.

first your send him a legal notice through an Advocate, most of the time people on receipt of legal notice return money to avoid litigation, if it does not work, then you can file a suit for recovery in the appropriate court of jurisdiction.

You may either file a case for recovery of your money, or you may file a suit for specific performance of contract, provided that you must be having a written agreement. How you paid money is more important, i.e. you paid through cheque or gave cash is of utmost important, as cheque amount deducted from your bank and increase in his account in itself is an evidence. Secondly, you are also having option to file criminal case, which you may not adopt as he is your relative.
