We Hope that, there is some agreement/writing/email communication between you and the builder to show that, the builder had engaged you for sale work and had agreed to pay you commission.
You have two options :
1. To file a Criminal complaint against the builder.
2. To file a CivIl Suit for recovery of the amount.
Even if you do not have any written proof of your engagement, you can still prove your engagement by the builder, if you have any witness who can testify in your behalf in the court of law.
