Once we file a case in what time frame does case comes up for hearing?

Based on the above info pl let me know 1.If I have a case The party is in Bangalore. I live in Delhi permanently My account is in Delhi. I have an account in Bangalore too. i am sure that the party does not have funds in the account. Reportedly he has closed the account. He is a builder once we file a case in what time frame does case comes up for hearing and in what time frame does the judge orders summon and in what time frame does it come up for hearing. can we settle out side court?

First of all, are you contemplating a civil suit or criminal trial? The procedure and process differ for both. In case of a civil suit, you first file your plaint and the matter is then listed before the judge, who issues notices to the defendants and fix a time for further hearing. This process of filing the suit and issuance of notice/summon may roughly take 45 days. If the defendant then appears in court or approaches you to negotiate a settlement, the process may take another 2 months. The same is only an estimate and cannot be accurately calculated. But keeping in mind the relevant factors, I would say roughly around 3-4 months.
If case of a criminal trial, from the filing of the complaint to issue of process would also take a minimum of 4 months. Again, this is only an estimate.

The matter will be placed before Hon'ble Magistrate/Judge within on next working day of filing at 2:00 pm in exceptonal cases it may take 2 working days from the date of filing the matter in registry of court except more time is not sought by the litigant or his counsel filing the matter. Generally the summons are issued on date of first hearing if magistrate/judge is convienced/ satisfied that matter con't be dismissed/rejected. You are always free to settle the matter out of court. In cases matter is settled out of court after cognizance taken by court in NI cases certain percent has to be deposoted in court i.e. After notice 10% etc.
