Money lent in exchange for land but papers are not original

I lended money in exchange for land if borrower fail to return. I have the land papers in original but the contract was not signed in a legal document. I've not received my money nor have the borrower surrender the land. It's almost 3years from the agreement date. How can I claim for the land or get back my money.

Dear Querist,
For a suit for recovery of money the limitation period is 3 years, without further delay file a case for recovery of money. In that suit u can file an IA for ABJ, meaning Attachment before judgment. You can file the original sale paper and state that there was oral agreement, u can also ask for permission to sell the property, this should perhaps help u to recover the amount. The above suit can be filed if it is within limitation period, i.e., within 3 yrs.
