Maid not willing to return borrowed money, how to recover?

I had a maid/servant orkingvwith us for 20 months from Aug 2014 to March 2016 for a salary of 12k. In Feb 2016 , she was in need of some money else her property would be seized by the bank since they failed to repay some loan amount. I transferred 50k to her husbands account from which the loan was taken. In March she asked me to keep 10k as a repayment to the 50k I had given her. She left her job that month and promised to return that amount. She has not returned the 40k so far and till last month when I spoke to her on phone she said she will repay it. But now she is telling we underpaid her when she was working with us, and is going to consider 40k as her salary. She is not willing to repay that amount. Is there anyway I can file a complaint and get the money back? The only proof I have is the 50k that I transferred to her husbands account via internet banking . Her regular salary goes to a different account. Please help.

f any person to whom you have given loan of any amount, then in such case you shall have the right to claim money amount from that person by filing a recovery suit under order 7 rule 2 of CPC against that person. But before you file any recovery suit you shall have to send a legal notice for the recovery of the said amount of loan by giving him 7 days to repay. If he does not pay the loan amount within 7 days of such period, then the civil proceedings shall be commenced against him.
