Is widow liable to pay back husband's dues being involved unknowingly

18-May-2023 (In Recovery Law)
My brother in law got(1 lakh) from someone for some business. My BIL got this money transacted directly from individual to my sister's A/C on Jan,2014. My sister does not know about this as my BIL was handling her accounts etc. My BIL died in April 2015. Now individual is demanding money from my sister. He is claiming that my BIL did not completed the business work. Is my sister liable to pay back the amount? There is no reciept, no written agreement. Is my sister legally liable to pay amount merely as it was sent to her A/C. May be my BIL owed money from him. She has 2 little girls,no job.

Since there is no agreement or any instrument showing any liability of your brother in law towards that person he cannot claim it from your sister. it might be some money which your brother in law had to taken from that person. Otherwise, it is always liability of the legal heirs to repay the liability of deceased. Without any legally enforceable document and proof of any contract he cannot claim any money from your sister and you are advised not to make any payment without any such document.
