I lent money to one of my friend and he is not willing to return.

I have a situation where I lent money to one of my friend who was suppose to invest in business, and after one year he has no business and is not willing to return my funds. The money was given purely based on trust. Please advise.

If there was any agreement between you and your friend then he is liable to pay as per that.

But if there is no agreement, then we need to show evidence of payment being withdrawn by you and thereafter file a civil suit for recovery.

It is important to ascertain whether the funds were lent by cheque or cash and whether or not an undertaking or agreement was entered into. Kindly provide details of the mode of payment and details of the agreement whether written or verbal if any. in the absence of any evidence If the amount was intended to be used as Capital for a business venture such financial transaction can be traced through their books of accounts. However prior to providing an appropriate legal advice on further action kindly furnish the above information.
