How to deal with partner denying to pay amount depicted in notary doc

Respected Sir/Ma'am I am Dipti, My husband is RCOM distributor in Nashik district. On start up our shop was partnership firm.But the partner has retrieved amount of Rs 4 lac in wrong ways.After some days my husband has made hime realise about it, at that time he has given cheque of Rs 1.20 lac, but the cheque has bounced 2 times and currently he is denying to give money. We are having notary about the cheque too. please guide us what action to do so that we will get our money soon.
Kindly file a civil suit for recovery of your money on the bases of the cheque and few other supporting documents.
