Gave loan to relatives but now they are refusing to return

me and husband gave 7 to 8 lac rupees in installments for education purpose to our relative but right now they reject to refund our money what to do plz help us

You can start by sending them a legal notice to return your money within a fixed period of time. If they deny to return, then file a suit for recovery against them.
PS: I hope you have at least some proof of providing them the money.

A loan amounts to a contract as per the law. Although if in written form it is always easier to prove the terms and conditions of the contract, oral agreement of loan is also equally binding in law. However terms of such a contract can be hard to prove in court. Even the existence of such a contract can be hard to prove, since such oral loan agreements are usually transacted with cash.

If a person is determined to sue the borrower over non-payment, they must be armed with as many evidences as possible, preferably documentary evidences.

If you have given loan to yourrelative by cheque or NFT, then you can file a suit of recovery.

Since you are attracted by the limitation of 3 years so you will have to file the same at the earliest by filing an application for condonation of delay thereby justifying the period of delay.

Visit our office with all relevant documents. As only After perusal of all records detailed advise is possible. First of all a notice for recovery of money os required to be issued. After then, suit for recovery of money may be instituted, in the court having jurisdiction over matter.

Though issuing legal notice is not mandatory, but, you should opt to get one issued to mount pressure and gauge your relatives intentions.
If the relatives do not pay then you may choose to file a recovery suit against him/her/them.
Documents and necessary particulars are required for thorough study and opine accordingly.
