Friend not returning the money lent to him

Dear Sir, I lent 3lakh to friend last year in June. He issued me three cheques of 1lakh each in place of it. With repeated reminders he has failed to return my money, in spite of telling him my various critical situation which came across during this period like my home loan, dad's health and my marriage. He failed to return and has been giving me excuses and delaying it. This is causing a lot of mental agony and stress. Could you advise what legal actions I can take to retrieve my money? I still have the cheques with me which I have not yet deposited in the bank. No dates are mentioned.

Dear Sir / Madam,

Irrespective of reminders you did not receive the money. So, you need to fill in the information on cheque and deposit it to the bank ( According to Negotiable Instrument Act u/s 138(a) cheque needs to be deposited in the bank within the 6 month of the date). If the cheque not cleared then you have ground to file Cheque bounce case which is criminal case against your friend.

I suggest that first you send your friend a legal notice, setting out all the particulars of the loan in it. If he does not respond to it, you can file a case for Recovery of Debt in the civil court.
