Friend is not paying the EMI for the loan he took what to do.

One of my friend, was in financial trouble, as his father met an accident. so he ask me to give some money. understanding his situation and trusting him. I give my credit card as help . he swap that card on some POS machine and withdraw the amount, he insist that put that amount into EMI, so he pay in installments. I done the same, he was paying the EMI every Month, but from last 3 month he is saying he will not able to pay the amount. I am in big- big trouble, I am not from very strong financial background, I am getting threatening call from the banks and i am in big stress, If the issue not solve may be i commit suicide,I understand i made the mistake.But please i need your help.Please guide me to get back my money.
There are two options available to you. 1. you can file a criminal complaint against your friend for the offence of cheating. if the police is not accepting the complaint, you can directly file a complaint in the criminal court of competent jurisdiction. 2. You can file a suit for recovery in the competent Civil Court. Pls. visit your local lawyer who, based on the documents availabale with you, can suggest you the best course of action.

Send him a legal notice for recovery of dues; however, incase he fails to pay your back the money, lodge a FIR against him for cheating you and committing Criminal breach of trust. Simultaneously, you may also file a recovery suit .
