Father took loan not alive now is family liable to pay back debt

12-Feb-2023 (In Recovery Law)

Recently my father passed away. he may have owed some debt to individuals who started visiting our place for recovery. Some of these possessed cheques issued by my father and also got passbook entries for the same. is the family liable to pay any such debt? also we received a notice from an advocate regarding one cheque that was deposited into my mother's account (without her knowledge) and the people claiming that money back. How can i defend?

If the people whom your father owed money have proof of lending money then legally his heirs are responsible to pay off the loan he took. Apart from that, if your mother and your father had a joint account for which the cheques were given then they can claim the cheques even after your father's death or the nominee of the account will be liable to entertain the cheques for the same account.
