Debt to be payed for my shares in the company

Worked as business development manager for an Indian based company from united states and holds greensward. Indroduce the USA client and Developed the business very well last 3 years and have details regarding all the payments the Indian company holds in email. Recently threatened by Indian company that they will not pay my 1.3 years’ salary and huge amount in their hands I quit the company 2 days before. I am in Boston want to put a claim to get my share that I . need to get.Need sincere advice

The facts could have been made more clear and elaborated a bit more. From what can be gathered it seems like a straight case of breach of contract by the company. Here the company can be compelled to act per the contract or/and pay compensation for loss caused by breach. I think that much is clear even to you.

The tricky part would be as to which court will have the jurisdiction to entertain the suit and that is where the facts are insufficient. We need to know the following:

1. Where was the contract entered into?

2. Whether the contract was taken down in writing and was otherwise executed as per law.

3. Whether there is an arbitration clause in the employment contract. Alternatively, is there a clause restricting the jurisdiction of the court.

4. Whether the job was quitted as per the terms of agreement

Hope that the Agreement is in place or Appointment letter executed/issued by the Indian
Company. If yes, please share. It is to be looked at. Your claim can be lodged with the Indian company by issuing the legal notice (as a first step).In the event of non-payment by the Indian company,a money recovery suit shall be required to be instituted before the Court having jurisdiction. However, it is to be looked at as to by virtue of what document the understanding between you and the Indian company got reduced in writing. Please contact with all details, so that an appropriate strategy can be carved.

serve a legal notice upon the company for your remaining salary and other dues. after that you can file a petition in court for remaining salary or can also filed before commissioner/Inspector for remaining salary and other dues.
