Corporate Consultancy refusing to pay for my services

25-Aug-2023 (In Recovery Law)
I'm a freelancer trainer and recently I gave a training to a top MNC company in India through a consultancy. Now the consultancy is refusing to pay me what was agreed upon. They are deducting 35% of my pay saying the client didn't pay (The client has payed their invoice) and so they are not going to pay me. I want to take legal action against the consultancy. How do I go further?

You are entitled to receive your due amount. If they have short-paid your fee alleging a flimsy reason, you need to issue a legal notice cautioning them to pay your balance amount failing which you would initiate legal proceedings against them. If they do not pay, file a money recovery suit in a civil court.

This is based on your contract with the Consultancy firm. If your agreement says that only when the client pays the entire amount to the Consultancy, you cannot receive your entire pay - you may find it difficult to take legal action. However if you have all the documentation regarding your fee, what you were to receive etc., then you can take a legal action.
