cheated by partners in chit business which is not registered

Dear Sir, my father was cheated by partners and now fully under debt. My father contacted sarpanch of thar area he said he will solve but after 2days customers and partners both attacked our family and when. They asked for life threat protection police refused and abused them and sent them back now what can we do to protect ourselves and how can we file a complaint on partners who cheated us and partners and customers are forcing us to sell our house and repay them and they blamed my father that he is the person who cheat ed.

I am very sorry to hear of your situation. At the outset I would wish to remind you that most debts are not inheritable unless you have co-signed along with your father. As far as the threat to your life and your family's safety is concerned, you should file an application under Section 156(3) of the Code of Criminal Procedure, 1973 to have an FIR registered and for an investigation to be conducted. You could further file a Complaint Case under Section 200 of the Code of Criminal Procedure, 1973. Both these remedies are usually perused together to strengthen the case. As far as the partnership is concerned and the debts it owes, you could file a suit for declaration and further reliefs absolving you from any liability to clear your or your fathers name. Consult a local lawyer in your area and draft a proper police complaint against the partners and be specific about cheating, fraud etc. Take this to the nearest police Station and file the complaint. Organised chit fund schemes are required to be registered with the Registrar or Firms, Societies and Chits. So go there and file a written complaint as well and mention how they have cheated you. Also make a complaint to the Ministry of Corporate Affairs who will order an investigation by the Serious Fraud Investigation Office. Try to find more people like you who have been cheated and escalate this with the higher authorities.
