If your grandfather died before December 20, 2004 or the said will was probated before the said date i.e, the partition was done before December, 20, 2004 then your aunt (Father's Sister) can not claim her share in the property as she is not entitled to it. However, if your grandfather died after 2005 amendment came into force then she is entitled to claim her share in the said property. Also, if she is entitled to claim the share in the property then you can give her the amount equal to the market value of her share in the property.
