Who will have the property in case the plaintiff dies during the case

23-Jul-2023 (In Property Law)
Assume a old man is fighting for the property in a civil court. After his death there are no legal heir to take the case further. The old man died during the pendency of the sase. Is this mean that the property will go in to the hands of the opponent's since there are no other persons to contest the case.

If there are no legal heirs, the legal heirs of Class-II will come on record. Even if there are no legal heirs in Class-II, then the Government will come on record.

But in any way it will not go to the opponent side.
