Who can claim a share in fathers property after father & mothers death
03-Dec-2023 (In Property Law)
In a Hindu Family, the Father has 3 sons and 1 daughter. The property is under the name of the Father, Mother and the youngest son. The Father and Mother passed away. Can other sons and the daughter claim the property? If so, who will have the upper hand?
Your father died intestate. It means he did not execute a will in anyone's favour. As per law the property will be devolve surviving sons , daughters So in short, you can claim the right over the property. You have to approach to the civil court to avail your legal right.
