Whether Vat is charged for under construction flat or resale flat

I am buying a resale flat in pune in reputed township and I am being charged for VAT, According to me VAT is only being charged on under construction flat I have asked them but they are saying as we could not charged this to the first owner we are charging it now is it right? if not how to convince them?
VAT is only charged on under construction flats. No VAT can be charged on a resale of a flat.
