What will be my right on my grandfather's property

my grandfather(GR), who is 92 yrs old has a house in delhi which has 3 floors.he has 2 sons,my father and my uncle,who have 2 children each. i am married female.others are males.in 2012,my GR gave me the possession of 1st floor in the house and I live there with my spouse.my GR lives on ground floor and one of my uncle's son lives on 2nd floor.As per will of my GR,which he made abt.30 yrs back,the house is to go to my grandmom after his death and then to his 2 sons,half each.my GR wants to give house to his 4 grandchildren, but my father and uncle do not want.what is my right after GR death.

Dear Ma'am,

Your right in the property will be decided per the inheritance law. please try to settle the matter peacefully in between the family and try to execute a family settlement agreement. If that is not possible then you have to file a suit for partition in the court of law.

Solution is very simple. Consult an advocate who can draft a fresh will. The previous will will be automatically invalidated. Your father and your uncle will have no right title or interest once the will gets effective. If the new will is not ready within proper time, then the Las will which is the current one will be effective and you your other brothers have no right to claim in the said suit property. You are living in the property will help you some point of time. But soon or later you will be evicted from the property and no court will help you out.

First question is whether your grandfather got built this property from own earned income or not. If this property was purchased by your grand father then he may execute the will and property shall be distributed as per will. In case there is no will then property shall be distributed as Hindu Succession act,1956 and you father may get his share. You can not claim any share till your Grandfather is alive.
