24-Sep-2023 (In Property Law)
At time of going for mesne profit to lead evidence in small causes court, my lawyer and counsell was the same person. During this time, before getting enquiry report and now have to go back to high court, my lawyer cum counsel, has now become a senior counsel in high court. I am now wondering what steps to take to get a new lawyer and a counsel as he now being a new counsel, cannot function as a lawyer.

Sir,

You have to take his no objection to heir you lawyer and if he disagree then you can send him a discharge notice and you can appoint a new lawyer by filing new vakalatnama and discharge notice along with it.

You can take no objection certificate from the existing lawyer and appoint new layer in place of old lawyer who act as senior counsel in Honerable High court. If you have faith then no need to change .
