what legal rights against delay in possession from property builder?

If there is adelay in handover of a group of flats in a apartment, is it advisable to file a case in consumer court individually by flat owners or is it better to form an association? Also if some flat owners form an association, if the rest of the owners dont want to join this group, what is the legal remedy for this owners who dont want to join the first group
it may appear that an association means more merit in the case and unity is strength. But if there is any point in terms of agreement has any penalty clause for delayed completion you can make use of it, irrespective of whether one or many file a case.
