What is widowed daughter in law's share in property?

We were 4 siblings(sons).but one brothers untimely demise very early after marriage and no children. after our father death his ancestral property was transferred to three sons equally in 1970.our widowed bhabhi did not remarried stayed with us in our family home. can now she can ask for her husbands share in court(after 40 years)? she has no children.she wants to gift her husbands(our deceased brother) share to one of our brothers. does she has any legal share???

The wife of the deceased brother can claim her husband’s share in the partition, now, as 40 years have passed, the said suit is barred by the limitation act. However, she can still file a suit for partition in the jurisdictional civil court along with an application for condonation of delay.

we have readout your query very carefully, you were 4 siblings but your one brother untimeely demise very early after marrige and no children , nd your bhabhi is live with your family, sir court ka new law hai ki husband ki property pe uski wife ka pura adhikar hai to , apki bhabhi aap sab ki property ki hakdar hai.
