What is the validity of a property partition decree
17-Nov-2023 (In Property Law)
Validity of a property partition decree Property partition suit of my mother filed in 1993 and final judgement in1996 , was in order stage and final decree was not sought from the court due to various issues , now I since I am back and aware of this , has reprocessed or reopened and got the final decree passed in Oct 2016 from the kannur Munsiff court. Defedents had not appealed or put any counter case after that till date . 1: It is 20 years since the order is passed, and judgement decree is released now - Is this valid and can i process this further. Will I have any legal issues 2:If this is not valid then what is the next action I should take up to validate this decree.
As you have obtained the decree from the court in 2016 you might have moved an application regarding the same. Once the court has passed final decree then kindly move an execution petition for the same.

It appears that facts , as disclosed, are incorrect or incomplete. When, admittedly, the final decree has been passed, and the defendants have not appealed, what is the real issue? Certainly, you have an advocate representing you; what is his advice?
