What is the right of mother in father's property
30-May-2023 (In Property Law)
My mother has 2 elder brothers.Their father's property was not equally shared among them.Does she have a right for equal share if we proceed legally?
If the share is not partitioned till date and if partitioned bfr expiry of 3 years .you can approach the civil court in your area for proper partition.thid can be done only by a good civil lawyer .thanks
After the death of Grand father the right of his property goes to his legal heirs(His children s and wife equally) . If the grand father was executed a will or document with regard to his property then the right is transferred according to the document which he had executed in his life time. If no documents are executed any of the legal heir want to get his share then he has to proceed legally by filing a partition suit. If so your mother will file a partition suit for getting her share in her fathers property from his siblings
I can assure you that your mother has got 100 percent legal right over the property. You have to fight legally in a proper manner. For that t h e first thing you have to do is to obtain the certified copies of the concerned property...
