What is the rented property vacation terms and conditions

Hi, We have our 2 BHK for a Lease Period of 3 years the lease ends by June.We had sent notice of vacation to our tenants who wanted an extension of another 3 years we asked him instead to stay on monthy rent basis initially he agreed but then later he refused,and before the 3 months completion of the notice period the tenant said he paid 3 Lakhs but we were not getting new tenants but now we have got new tenant for rent but the old tenant is stating that he will vacate tomorrow itself or whenever he gets house and he wants us to pay his the entire 8 Lakhs that he had paid for the Lease and will pay later for the repair,but even after we pay him the 8 Lakhs he will not vacate he will only vacate when he gets a new house which may be tomorrow or may take 6 months he says hes doing this because of us as he has lost the token advance of 3 Lakhs that he had paid for the new house he was wanting to shift.Is this Legal whatever he is doing what options do we have.Please advice..........

It is quite likely that he will stay on in the house even after you repaying his lease amount. And he will not agree for vacating and getting paid on handing over of keys. You get a legal notice issued to him to know his exact stand

Sir,
As you informed that you have already given him the termination notice and the notice is also expired. It was his duty to vacate the premises on the day of termination of lease deed. In case if he will not vacate you can proceed against him filing eviction suit. here the tenant cant say that he will vacate when he gets the new house. because once the lease period is expire and he will loose lease right over the property.


As if your informed, if he continued there as a monthly tenant, a new agreement to be executed and
