If your grandmother had marketable title to the property and left behind the same as intestate then the said property shall automatically devolve equally on all her legal heirs or successors in interest.
Thus your deceased mother being one among the legal heirs to your deceased grandmother, her legitimate share in the intestate property shall devolve on all her own legal heirs/successors namely her children and husband.
You being one of the legal heirs to your deceased mother, you are entitled to an equal share out of your mother's share in your grandmother's property hence you can very well file a partition suit seeking partition and separate possession of your legitimate share in it.
Your uncle cannot deny this, he can be dragged to court and the court will decide against his decision.
