The succession certificate is only issued in respect of all legal heirs if its not a testamentary succession and intestate succession therefore since as per your query your brother is against you and he will not be giving his NOC therefore obtaining succession certificate will be bit complexed opinion as all legal heirs assent is required for the same in your case it would be bit difficult.Therefore you can go ahead and obtain surviving member certificate through SDM of your zone and you can also apply for succession certificate and simultaneously you can file suit for partition ,possession and title/declaration .You can also seek damages along with the same please contact for any further queries thanks.

In order to get a succession certificate you have to approach district court with a petition along with details of your property, legal heirs, death certificate of the owner of the property. Thereafer, notice will be served to all the legal heirs to be present before court.

In view of a succession certificate you should file a suit for succession certificate n district court and for this purpose I suggest you to have meeting with your advocates because there might be other property of which you have to claim and if you will not claim other properties then it will be considered as relinquished so kindly have a meeting with your advocate
