What is Daughters right in property whether it is ancestral property.

06-May-2023 (In Property Law)
I am staying with my mother from 16 to 17 yrs and take care of my ailing mother. My father gifted the property to his daughter in law without giving any knowledge to my mother. Now my mother expired and my father, brother, his wife, his son and daughter in law kicking me and my children out. My grand mother and grandfather and father were refugees of 1947. My father got a claim from govt and then purchased the house in 1958 and after 10 yrs he sold this house and purchased a plot with this money. My mother, my sister and me did labourious work in constructing the house. My grand father was trader and my father took all his money and throw him out from the house in 1958. Now all the members started harrasing us by different tricks. Is this property called ancestral? Can they illegally throw me out without filling a suit?

Hello, there are many solutions, but without knowing the documents it's little bit difficult to suggest any points. It is necessary to know about the mode of transfer, like WILL or any other mode. So kindly revert back ASAP.

I have carefully gone through your query.
I would like to know did your mother had any share to the ownership in plot and is there any proof that the money spent to purchase plot was not of your father.
I would like to know some more information.
Feel free to have a word with me.
All the best
