10-Feb-2023 (In Property Law)
Hello Sir/Ma'am There is a 40x60 residential plot in Bangalore in my Grandfather's name who passed away in 2014 without leaving any WILL. My grandmother passed away in 2001. They have 6 children 3 male and 3 female. My father is asking for to sell that site and give him his share but the other 5 are not ready to sell it. lots of discussion have happened and they are very rigid. Even if we go to court what is the possible outcome. we are in grave need of money so whats the best approach to deal with this situation.

Your father being the member of the joint family has vested right in the property, in the event if other members of the family is not cooperating for partition by way sale , your father can file suit for partition before jurisdictional court, there is certain chances of succes in the suit.

The best way is to file a suit for partition of your share since your relatives are not willing to sell the property. The Court can direct anyone among the legal descendants to take the property and pay others for their respective share .You may contact me with all the documents for further legal help.
