Want to know whether property title is good or not
21-Jan-2023 (In Property Law)
We brought a property in 2004 from a owner at that time his title was clear now there is a disput between that owner and 3rd party regarding the our property. 3 rd party is saying that we do not own the property anymore. we want to know that whether we hold good title or not
Dear Sir the rights of ownerships in a immovable property depends upon the title documents which one holds in his favor duly executed by the previous owner in their owner of if they are the originally allotted to them then the deeds of allotment.
Hello,
Property title is very important, on any certain point of time, selling that property would be little difficult if you don't have a good title. One more thing I want to add, that registration of that same property also necessary. After verification of the documents I would be able to tell you about the title.

See if you have the valid title deed then you need not worry. For addressing your issue i need to see documents such as:
1. The title deed
2. Sale deed
3. Stamp duty paid and registration papers
4.details of the seller
5. details of accusation by the 3rd party

The title records from the local registrar office will be required to examine and all certified copies in relation to the property will have to be extracted. Ideally, you should also move an appropriate application before the court in which the suit has been filed by the third party and get yourself impleaded. This shall prevent in pronouncement of any adverse order in your absence against your property.
The title of the property completely depends on the possession and title transferred through
documents. Therefore what documents have been executed between you and the second party is important. Therefore on what basis the third party is claiming is also important. Therefore a suit for declaration and title can be filed along with other remedies besides this if there is defacto title because of the mistake of second party even a FIR can be lodged. Therefore please contact for further details.
