Vacation notice received to vacate acquired land

13-Oct-2023 (In Property Law)
Hello Sir, . I have question regarding property issue... We have empty land about 30x30 next to our house and we were using this land from pas last 60-65 years. We don't have any document related to it but it is in the same survey number. We recently compounded this space and then local gram panchayat has sent us notice to vacate stating it belongs to panchayat. We requested the related documents from Panchayt but they are not sharing it with us. Please advise on how this can be dealt. Regards,

Firstly, what do you mean by 'same survey number'?
Just because you were using the adjacent property till now, it does not become yours.
You should have registered this in your name.
The panchayat has the right to dismantle the compound you have erected treating it as illegal construction and trespass.
In any case, apply under RTI Act and collect related documents from the panchayat.

the governmental offices are bound to be transparent. if they have sent you a notice, then please ask them the grounds for sending the same and the dcuments pertaining to it. if they do not oblige, please apply for the required information through the right to information act, through which they are bound to provide you the documents that you seek. but please be specific in the documents that you require, as vague RTC applications will not be addressed to in a proper manner
