Uprooting of tree caused damage to neighbors property who is liable
23-Jun-2023 (In Property Law)
One of my tree has uprooted due to heavy rains and wind and damaged my neighbour's roof and compound wall. Before the rains, the tree neither posed damage to anyone of us nor were there any signs of uprooting. My question is, since the damage has been caused due to unfavourable weather conditions. who is liable to bear the damage to property?
This is called as an Act of God event. Since there were no signs of the tree being harmful and the damage was caused due to the rains, you are not responsible for the damage caused.
