Uncle sold my share of property what action can I take

Hello Sir, My query is : During the death of my grand father the property was a joint property. I am the only successor of the property and the Ancestral home. My uncle and her sister ( i.e. my aunt) are selling the property without any demarcation or partition. I stay away from my home town for my work. Also they have sold more then what they get in there share if any partition has been done. In that case is there any law to stop and recover the money for the share which they have sold over and above their share? Also can i suit a case on the purchaser who bought the undivided property?

1. This is what happens to a person who sleeps over his right.
2. However your right is not extinguished as yet. So get your share in the property you have to file a suit for partition and injunction. Claim your due share therein.
3. File an injunction petition to restrain other co-sharers in meddling with the property any more.

You should file a suit against your uncle, aunt and the purchaser. The suit can claim multiple reliefs, including recovery of money, declaration of title, and stay of the sale. I would strongly suggest filing the suit without much further delay.
